RUSHFRAME USER AGREEMENT

1. Introduction

Thank you for using Fortech LLC (registered at Georgia, Tbilisi City, Saburtalo District, Sulkhan Tsintsadze Street, N11, Floor 7, Apartment N4, Index 0160, registration number 405736315, "RushFrame", "we", "us", "our").

RushFrame is a gaming network optimization application for iPhone and iPad that uses advanced routing technology to reduce ping, minimize latency, and enhance online gaming performance.

BY USING RUSHFRAME, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

Age Requirement: You must be at least 18 years old to use RushFrame. Minors require parental consent.

Privacy Policy: Your use is subject to our Privacy Policy. We may process your data on servers outside your region.

Updates: We may update these Terms at any time. Continued use after changes means you accept the updated Terms.

2. Your Account

• Keep your account information confidential
• You're responsible for all activities under your account
• Don't share, sell, or transfer your account
• Don't collect data from other users
• Notify us immediately of unauthorized access

3. Services & License

What We Provide:

• Gaming network optimization for reduced ping and latency
• Network acceleration for selected games from our collection
• AI-powered connection path selection
• Daily free data rewards (see Section 4)
• Performance analytics and monitoring
• Server selection across multiple locations

Your License:

Personal, non-transferable, revocable license to use RushFrame solely for lawful gaming network optimization on your iPhone or iPad.

You Must NOT:

• Use RushFrame for illegal activities
• Reverse engineer, modify, or copy the app
• Share your account with others
• Use bots or automated systems to abuse features
• Resell or redistribute the service
• Use in violation of applicable laws in your jurisdiction

4. Daily Rewards & Subscriptions

Free Version - Daily Rewards

• Earn 100 MB per daily login
• Data accumulates with consecutive logins (Day 1: 100MB, Day 2: 200MB, Day 3: 300MB, etc.)
• Miss a day = reset to 100MB
• Free data is non-transferable and cannot be sold
• Subject to fair use policies
• We may modify or discontinue at our discretion

RushFrame Pro Subscription

Unlimited data, priority servers, advanced features.

Pricing:

• Monthly: $4.99/month
• Annual: $29.99/year

Billing:

• All payments through Apple App Store
• Auto-renews unless canceled 24+ hours before renewal
• Manage via iPhone Settings → Subscriptions
• NO REFUNDS for partial periods (except where required by law)

Promotional Codes:

• May be offered for extra data or discounts
• Cannot be sold, transferred, or exchanged for cash
• Subject to expiration and our discretion

5. Payment & Refunds

Payment Processing: Apple handles all payments. We don't store your payment info.

Refund Policy:

• General: All purchases are final and non-refundable
• EU/UK/Switzerland: 14-day refund right (may be pro-rated)
• Other regions: Per local law and Apple's policies

Taxes: You're responsible for all applicable taxes and fees.

6. User Conduct

You Agree To:

• Use RushFrame legally and responsibly for gaming network optimization
• Comply with all applicable laws in your jurisdiction
• Not use for illegal activities, hacking, or malware distribution
• Not abuse daily rewards through fraudulent means
• Use the service in accordance with its intended purpose

We May Suspend/Terminate If:

• You violate these Terms
• You use the service in violation of applicable laws
• You abuse rewards or promotional codes
• We detect suspicious activity or fraud

Upon termination: Access revoked, no refunds (unless required by law), all benefits forfeited.

7. Disclaimers & Limitations

"AS-IS" Service:

RushFrame is provided "AS-IS" without guarantees. We disclaim all warranties including merchantability, fitness for purpose, and uninterrupted service.

No Guarantees:

We do NOT guarantee:

• Specific ping reduction or performance improvements
• Improved gaming experience for all users or games
• Compatibility with all games or platforms
• 100% uptime or error-free service
• Service availability in all regions

Results Vary Based On:

• Your internet connection and speed
• Geographic location and game server distance
• Game server infrastructure and network conditions
• Device capabilities
• Factors beyond our control

Not Responsible For:

• Actions taken by game publishers or gaming platforms regarding your account
• Incompatibility with specific games or services
• Third-party actions, policies, or network issues
• Data loss or device damage
• Any consequential or indirect damages

Liability Cap:

Our total liability limited to the lesser of: (1) amounts you paid in past 6 months, or (2) $100 USD.

User Responsibility:

You are responsible for:

• Ensuring compliance with applicable laws in your jurisdiction
• Reviewing and complying with terms of service of games and platforms you use
• Understanding how network optimization may affect your gaming experience
• Any consequences from using RushFrame

8. Indemnification

You agree to defend and hold harmless Fortech LLC from all claims, damages, and expenses (including attorney fees) arising from:

• Your use or misuse of RushFrame
• Your violation of these Terms
• Your violation of third-party rights or applicable laws
• Your use of the service in your jurisdiction
• Any content you transmit through the service

We control defense of claims, and you agree to cooperate.

9. Intellectual Property

All RushFrame trademarks, software, algorithms, and content are our exclusive property. You receive no ownership rights.

You May Not:

• Copy, modify, or distribute our technology
• Reverse engineer our algorithms
• Use our trademarks without permission

10. Dispute Resolution

Informal Resolution First:

Contact [email protected] before legal action. We'll work to resolve within 60 days.

Governing Law:

• EU/UK/Switzerland: English and Welsh law (with local consumer protections)
• North America: Georgia law
• Other regions: Georgia law

Nothing limits your right to use mandatory local consumer protection laws.

EU Users:

Access dispute resolution bodies: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies

North America Users:

Disputes may be resolved through binding arbitration.

Opt-Out: Email [email protected] within 30 days stating: "I opt out of binding arbitration" with your name and email.

11. Export Compliance

You represent that:

• You are not in a country subject to export restrictions
• You are not on any government restricted party lists
• You will comply with applicable export control laws

12. Regional Terms

EU/UK Residents:

• 14-day withdrawal right for subscriptions
• GDPR rights apply (see Privacy Policy)
• Local consumer laws apply

13. Apple App Store Terms

• These Terms are between you and Fortech LLC, not Apple
• Apple not responsible for RushFrame or support
• We handle all claims related to RushFrame
• You must comply with Apple's terms of use
• Apple is third-party beneficiary of these Terms
• License limited to Apple devices you own/control

14. General

Modifications: We may update services, features, or servers at any time.

Termination: We may suspend or terminate for violations. No refunds upon termination (unless required by law).

Force Majeure: Not liable for failures beyond our control.

Entire Agreement: These Terms and Privacy Policy constitute full agreement.
